General Terms and Conditions of Swisskalk GmbH
1. General Terms
The General Terms and Conditions apply to all transactions involving the sale of water softening systems and accessories by Swisskalk GmbH.
2. Services provided by Swisskalk
Swisskalk supplies the customer with the products as described in the respective order confirmation. The description in the order confirmation takes precedence over descriptions in catalogs, flyers, or on the website.
The delivery includes the installation of the systems.
3. Customer obligations
The customer is responsible for timely payment of the invoice corresponding to the order confirmation.
The customer must ensure that no modifications or tampering are made to the systems unless such actions are explicitly described or authorized by Swisskalk.
4. Warranties/Guarantees
Swisskalk guarantees that the installed water softening systems will function properly for the period specified in the order confirmation. Functioning means that the systems are able to measure the hardness level within the defined range and can be adjusted to the desired hardness level. The tolerance regarding measurement results is specified in the order confirmation.
Furthermore, Swisskalk guarantees that the customer becomes the unrestricted owner of the system.
All other warranties and guarantees are expressly excluded.
5. Order Confirmation
Swisskalk does not conduct active telephone sales.
Orders placed by email, telephone, in person, or in writing are always confirmed in writing. The contract with the customer becomes effective upon issuance of the written order confirmation, which specifies the product, delivery date, costs, and the duration of warranty and guarantee in accordance with these General Terms and Conditions.
6. Technical Provisions
The customer will be informed, at the latest upon order confirmation, about the installation process and necessary requirements (such as available power outlets, etc.). Any additional costs required to meet the installation prerequisites are to be borne by the customer.
7. Deadlines/Timeframes
Swisskalk guarantees the delivery period as stated in the order confirmation. If this period is exceeded, the customer has no further claims unless the delay exceeds 14 days, after which the customer may withdraw from the contract.
In the event of a malfunction, Swisskalk guarantees that a technician will arrive within a maximum of three working days.
The payment term for invoices is 10 days net.
8. Maintenance
Swisskalk recommends concluding a maintenance agreement in which all aspects of the system’s maintenance are clearly defined.
For customers who do not enter into a maintenance agreement, Swisskalk provides a warranty for proper system functionality only if the disinfectant/silver resin is regularly refilled or replaced. The associated costs are to be borne by the customer.
9. Intellectual Property of Swisskalk
By purchasing the system, the customer acquires ownership of the specific unit but not the right to copy or use the systems in any commercial manner. All related rights remain the property of Swisskalk.
10. Place of Jurisdiction and Applicable Law
Swiss law shall apply.
The place of jurisdiction is Solothurn.
